List of claims against Kaupthing Bank accessible to creditors

The Winding-up Committee of Kaupthing Bank has made the list of claims lodged against the Bank available to creditors on a secure website. In total of 28,167 claims were lodged against Kaupthing Bank by the deadline for lodging claims on 30 December 2009. Claims against the Bank were received from creditors in 119 countries, over half of them interest claims from Germany, mostly related to deposits.


Among the largest creditors are domestic parties, domestic and foreign financial institutions, and various investment funds abroad, including venture capital funds, mutual funds and hedge funds.


The total amount of claims lodged is ISK 7,316 billion, at the ISK exchange rates of the Central Bank of Iceland on 22 April 2009. The aggregate amount of claims exceeds the Bank's liabilities as recognised in its balance sheet of 30 June 2009. The difference can in part be explained by claims lodged for deposits which the Bank has already repaid, significant amount of bond claims and some deposits claims lodged in duplicate or triplicate, off-balance sheet items, such as claims for damages and guarantees. Furthermore, creditors generally lodge claims at maximum levels. The aforementioned claims add up to at least ISK 2,900 billion.


The Winding-up Committee has made decisions on over 16,000 claims or approx. 57% of the total number of claims lodged. By far the greatest numbers of those were for interest on deposits from Germany, which were received in a fairly steady stream throughout the claims period. Most claims from banks and financial undertakings, on the other hand, were received near the end of the deadline.

The list of claims is available for creditors on a secure website and at the offices of the Winding-up Committee at Borgartun 26 in Reykjavik. A creditors’ meeting will be held on Friday, 29 January, at Hilton Hotel Nordica, in Reykjavik, to discuss the list of claims and decisions by the Winding-up Committee on claims lodged, to the extent these are available. A follow-up creditors’ meeting will be held on 18 May 2010 to present decisions on claims which have been made at that time. A third creditors’ meeting to discuss decisions on claims can be expected in the autumn.

 

 

Kröfuskrá Kaupþings banka birt kröfuhöfum

 

Ríflega 28.000 kröfum lýst í Kaupþing

 

Slitastjórn Kaupþings banka hf. hefur birt kröfuskrá á vefsvæði fyrir kröfuhafa. Alls var 28.167 kröfum lýst í Kaupþing innan kröfulýsingarfrests sem lauk 30. desember sl. Lýstar kröfur í bankann bárust frá 119 löndum, þar af var ríflega helmingur vaxtakröfur frá Þýskalandi.


Meðal stærstu kröfuhafa eru innlendir aðilar, innlendar og erlendar bankastofnanir, auk ýmissa erlendra fjárfestingarsjóða, s.s. framtakssjóða, verðbréfasjóða og vogunarsjóða.


Heildarfjárhæð lýstra krafna í Kaupþing nam 7.316 milljörðum króna miðað við gengi Seðlabanka Íslands þann 22. apríl 2009. Heildarfjárhæð lýstra krafna er hærri en skuldir samkvæmt efnahagsreikningi bankans miðað við 30. júní sl. Skýringar á því má m.a. rekja til oflýstra krafna vegna innstæðna sem Kaupþing hefur þegar greitt, tví- og þrílýsinga vegna ýmissa innstæðna og skuldabréfaútgáfa bankans og krafna sem falla utan efnahagsreiknings, s.s. skaðabótakrafna og ábyrgðarkrafna. Auk þess er ítrustu kröfum jafnan lýst. Samanlögð fjárhæð vegna framangreindra atriða nemur a.m.k. 2.900 milljörðum króna.


Slitastjórn hefur tekið afstöðu til rúmlega 16.000 krafna eða u.þ.b. 57% af heildarfjölda lýstra krafna. Langflestar þeirra eru vaxtakröfur frá Þýskalandi, enda bárust þær jafnt og þétt á kröfulýsingartímanum. Hins vegar bárust kröfur banka og fjármálafyrirtækja flestar undir lok frestsins.

Kröfuskráin er aðgengileg kröfuhöfum á lokuðu vefsvæði og á skrifstofu slitastjórnar að Borgartúni 26. Fundur verður haldinn með kröfuhöfum föstudaginn 29. janúar á Hilton Hotel Nordica þar sem kröfuskráin og afstaða slitastjórnar til lýstra krafna, að svo miklu leyti sem hún liggur fyrir, verður til umræðu. Framhaldsfundur með kröfuhöfum verður haldinn 18. maí 2010 þar sem kynnt verður afstaða til þeirra krafna sem þá verður búið að fara yfir. Gert er ráð fyrir þriðja fundinum með kröfuhöfum vegna afstöðu til krafna í haust.
